Privacy Policy under the GDPR
Data protection is of particular importance when using our website. In principle, it is possible to use our website, www.JGA-Bike.de, without providing any personal data. We only process users’ personal data to the extent necessary to provide a functional website and to supply and deliver our services.
As a general rule, personal data is processed only with the user’s consent. An exception to obtaining prior consent applies only when obtaining such consent is technically or practically impossible and the processing of the data is permitted by statutory regulations.
Our website, www.JGA-Bike.de, serves as a platform regarding party bikes, beer bikes, and prosecco bikes. Users have the opportunity to obtain information on this topic easily and without obligation; however, at the user’s express request, we also connect them with commercial partners offering services and goods related to party bikes, beer bikes, and prosecco bikes. Users have the option to visit our partners’ websites via links or to provide us with their data for forwarding to our partners. Personal data is processed during these procedures; further details are provided in the sections below. (1) Legal bases
Where we obtain the data subject’s consent for the processing of personal data, Article 6(1)(a) of the GDPR serves as the legal basis for the data processing.
Where we have a contractual relationship with the data subject and the processing of personal data is necessary for the performance of our contractual obligations, the data processing is based on Article 6(1)(b) of the GDPR. This also applies to processing operations that are necessary for the initiation of contractual relationships.
Where the processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Article 6(1)(c) of the GDPR serves as the legal basis.
Where processing is necessary to safeguard the legitimate interests of our company or a third party, and the interests, fundamental rights, and fundamental freedoms of the data subject do not override the former interest, the data is processed on the basis of Article 6(1)(f) of the GDPR.
The personal data of the data subject will be deleted or blocked as soon as the purpose of storage ceases to apply under the aforementioned legal bases. Storage may also continue if provided for by the legislature in regulations to which we are subject. The stored data will also be blocked or deleted when the storage period prescribed by the cited regulations expires, unless further storage is necessary for the fulfillment of contractual purposes. (2) Controller within the meaning of the GDPR
The controller within the meaning of the General Data Protection Regulation (GDPR), other national data protection laws, and other data protection provisions is:

(3) Contact form and e-mail contact
We offer a contact form for certain services that can be used for electronic contact. If a user avails themselves of this option, the data entered into the input mask is transmitted to us and stored. The following data may be entered: name, address, telephone number, e-mail address.
Your consent is obtained for the processing of this data during the submission process, and reference is made to this privacy policy.
Alternatively, contact can be made via the provided e-mail address. In this case, the user’s personal data transmitted with the e-mail will be stored.
If the user so requests, their data will be passed on to specifically designated third parties for the purpose of submitting a quote requested by the user. The transmission of data serves the purpose of submitting a contractual offer in accordance with the user’s specifications; the legal basis for data processing in this regard is Art. 6(1)(b) GDPR. In other cases, the legal basis for data processing is the user’s consent pursuant to Art. 6(1)(a) GDPR.
The processing of personal data from the contact form or an email serves to handle the contact request in accordance with the user’s inquiry and instructions. Other personal data processed during the submission process serve to prevent misuse of the contact form and to ensure the security of our information technology systems.
Data transmitted by the user is deleted once the purpose of its transmission has been fulfilled. For data transmitted via the contact form or email, this occurs when the respective conversation with the user—or the forwarding of data to third parties as requested by the user—has concluded.
The user has the right to revoke their consent to the processing of personal data and to object to the storage of their personal data at any time. Notification by the user—whether orally or in writing—is sufficient for this purpose; no specific communication channels are prescribed. We recommend notification via email. In such cases, all personal data stored by us in the course of the contact via the contact form or email will be deleted.
(4) Provision of the website and creation of log files
Each time our website is accessed, our system automatically collects general information from the computer system of the accessing device.
The following data is collected:
– Information regarding the browser type and version used
– Date of access
– Websites from which the user’s system reaches our website
– User’s IP address
This data is also stored in our system’s log files. The collected data is not stored in conjunction with other personal data of the user.
The legal basis for the temporary storage of the data and log files is Article 6(1)(f) of the GDPR. The system’s temporary storage of the IP address is necessary to enable the delivery of our website to the user’s computer. The user’s IP address must remain stored for the duration of the session. Log files are stored to ensure the functionality of the website. Furthermore, we use the data to optimize the website and to ensure the security of our IT systems. The data is not analyzed for other purposes, such as marketing.
The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of data collected to provide the website, this occurs when the respective session ends. Generated log files are deleted after no more than 7 days. If data is stored beyond this period, the collected IP addresses are deleted or anonymized so that the accessing client can no longer be identified.
Collecting data to provide our website and storing data in log files is essential for the operation of the website; the user therefore has no option to object to this processing.

(7) Web analysis using Matomo
We use the open-source software tool Matomo (formerly PIWIK) on our site to analyze our users’ browsing behavior. The software places a cookie on the user’s computer (see above regarding cookies). When individual pages of our website are accessed, the following data is stored:
– two bytes of the IP address of the user’s accessing system
– the webpage accessed
– the webpage from which the user arrived at the accessed webpage (referrer)
– the subpages accessed from the webpage being viewed
– the duration of the visit to the webpage
– the frequency with which the webpage is accessed
The software runs exclusively on our website’s servers. Personal data of users is stored only in this context. The data is not passed on to third parties. The software is configured so that IP addresses are not stored in full; instead, two bytes of the IP address are masked (e.g., 198.123.xxx.xxx). Consequently, it is no longer possible to link the truncated IP address to the computer accessing the site.
The legal basis for processing users’ personal data is Art. 6(1)(f) GDPR. The use of Matomo enables us to analyze our users’ browsing behavior. By evaluating the data, we gain information about the use of individual components of our website, allowing us to continuously improve our online services and their user-friendliness.
The data is deleted after evaluation. This occurs no later than 14 days after collection. Cookies are stored on the user’s computer and transmitted to us. Users have full control over the use of cookies and can disable or restrict their use via their internet browser settings. Cookies that have already been stored can be deleted by the user at any time. However, if cookies are disabled for our website, the website’s functionality may be impaired. Where the processing of personal data concerning you has been restricted, such personal data shall—with the exception of storage—only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.
If the restriction of processing has been imposed in accordance with the aforementioned conditions, you will be informed by the controller before the restriction is lifted.

·2
·3 Exceptions
The right to erasure does not apply to the extent that processing is necessary
(a) for exercising the right of freedom of expression and information;
(b) for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
(c) for reasons of public interest in the area of public health in accordance with Art. 9(2)(h) and (i) as well as Art. 9(3) GDPR;
(d) for archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes in accordance with Art. 89(1) GDPR, insofar as the aforementioned right is likely to render impossible or seriously impair the achievement of the objectives of that processing; or
(e) for the establishment, exercise, or defense of legal claims.
·1
·2 E. Right to be informed
If you have asserted the right to rectification, erasure, or restriction of processing against the controller, the controller is obliged to communicate this rectification or erasure of data or restriction of processing to each recipient to whom the personal data concerning you have been disclosed, unless this proves impossible or involves disproportionate effort.
You have the right to be informed by the controller about these recipients.
·1
·2 F. Right to data portability
You have the right to receive the personal data concerning you, which you have provided to the controller, in a structured, commonly used, and machine-readable format. Furthermore, you have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that
(a) the processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR or on a contract pursuant to Art. 6(1)(b) GDPR, and
(b) the processing is carried out by automated means.
In exercising this right, you also have the right to have the personal data concerning you transmitted directly from one controller to another controller, where technically feasible. The freedoms and rights of other persons must not be adversely affected by this.
The right to data portability does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
·1 G. Right to object
You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on Art. 6(1)(e) or (f) GDPR; this also applies to profiling based on these provisions. The controller shall no longer process the personal data concerning you unless the controller demonstrates compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims.
Where personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent that it is related to such direct marketing.
If you object to processing for direct marketing purposes, the personal data concerning you shall no longer be processed for such purposes.
In the context of the use of information society services—and notwithstanding Directive 2002/58/EC—you have the option to exercise your right to object by automated means using technical specifications.
·1 H. Right to withdraw consent under data protection law
You have the right to withdraw your consent under data protection law at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
·1
·2 I. Automated individual decision-making, including profiling
You have the right not to be subject to a decision based solely on automated processing—including profiling—which produces legal effects concerning you or similarly significantly affects you. This does not apply if the decision
(a) is necessary for entering into, or the performance of, a contract between you and the controller,
(b) is authorized by Union or Member State law to which the controller is subject and which lays down suitable measures to safeguard your rights and freedoms and legitimate interests, or
(c) is based on your explicit consent.
However, these decisions shall not be based on special categories of personal data referred to in Article 9(1) GDPR, unless Article 9(2)(a) or (g) GDPR applies and suitable measures to safeguard your rights and freedoms and legitimate interests are in place.
In the cases referred to in (a) and (c), the controller shall implement suitable measures to safeguard your rights and freedoms and legitimate interests, which include at least the right to obtain human intervention on the part of the controller, to express your point of view, and to contest the decision.
·1
·2 J. Right to lodge a complaint with a supervisory authority
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or place of the alleged infringement, if you are of the opinion that the processing of personal data concerning you violates the GDPR.
The supervisory authority with which the complaint has been lodged shall inform the complainant of the progress and the outcome of the complaint, including the possibility of a judicial remedy pursuant to Art. 78 GDPR.
